As our 2008-2009 Season draws to a close, this month’s May 11th Meeting served as our final
educational meeting of the year. For their (10) years of (tenure) Chapter Membership, Tenure Pins were awarded to Past Chapter President Galina Datskovsky and Current Chapter President Melissa Dederer, Past and Current Board Members Vladimir Alfaro and Lauren Barnes. Federal Requirements for Personal Information Protection,” was timely and drew friends and Chapter Members who manage information in both domestic and international markets.
An informative presentation, made gloriously interactive by peeked attendee interests, several points to remember included the fact that no one law that covers every privacy need; more laws, Acts and amendments are needed. Among the 79 million records reported compromised at the end of 2007, almost all were to due to internet/computer reliance, data sharing, theft and organizations selling information or gaining access through the acquisition of other organizations. Moreover, folks throw away without shredding, they phish, hack, spam, stalk, Google, Yahoo, prey upon children and unscrupulously misuse information. As such, everyone in our society today needs information privacy; children, citizens, employees, customers, consumers, medical care recipients and even, Virginia’s home State of Virginia! Last year, someone hacked into the State’s medical database. For many months now, and by email, they have been holding State pharmacy records for a $10 million ransom!
We know that Social Security numbers, medical records under HIPAA and personal identifiers top the list of privacies to be protected. What RIMs run into most are the laws and regulations effecting the lifecycle of records from creation, file management, protection and access to retention/disposition. While our Federal Laws have done much; included several definitions of RIM terms, a single “Act” like the Patriot Act for example, changed some 8-9 existing laws in a single bounce, we have not kept pace with the demands of bodily, territorial and communications privacy (including CCTV and Google Maps aimed into residential windows) as well as our European counterparts. In fact, the EU has felt the US has been “too lax;” adding that it “permits too much and must change, in order to do business in the EU.” Sure, “the EU’s tougher about everything but not all of its member’s laws are harmonious.” Much the same as we face challenges in Motor Vehicles Departments selling motorist’s information to insurance companies, credit card, medical records companies and so on. But while “the bad guys never sleep,” neither does our Congress. Virginia’s Research Report was limited to only high profile cases and 28 Federal Laws, their requirements, misuse guidelines and consequences. Please refer to her Table at the end of her paper.
Attendees discussed differing markets and styles of recordkeeping in China and Russia. Also, discoverability in the US remains a concern where today, “lawyers and firms are going after records resident at “your” lawyer’s offices!” So now, more than ever, discard records according to the rules.
